Tom is a trial lawyer in Louisville with a focus on employment law. He's a Morgan Pottinger McGarvey shareholder, a member of the firm's Executive Committee and chairperson of the Litigation Practice Group. He has been named a top plaintiff lawyer, specifically employment lawyer, by Super Lawyers, each year since 2017. Tom began his career as a prosecutor in Philadelphia, Pennsylvania, and then as a felony prosecutor in Louisville, Kentucky, where he served as Deputy Trials Division Chief under the Commonwealth Attorney. In 2011, he joined Morgan Pottinger McGarvey and uses his trial experience to help individuals who have been either injured or wrongfully terminated from work. Tom has chaired more than twenty jury trials, more than ten bench trials, has argued in both state and federal appellate courts, and has extensive administrative court experience as well.
Tom has long been active in the brain injury community, beginning in 2002 when he was a policy analyst for the Brain Injury Association of America. He is the former president of the Brain Injury Alliance of Kentucky and continues to serve on its board. In addition, he previously worked for several years for two United States Senators.

Tom Coffey was the lead counsel for Jason Moseley, a former Louisville Metro Police Department officer, who was awarded $453,000 by a jury after winning a verdict in a retaliation case. Moseley sued LMPD and his former Sergeant, Anthony Doninger, for retaliation after he reported a fellow detective in the department’s Sex Crimes Unit for an alleged sexual assault.

Verdict: For Plaintiff Jennifer Mick on her claims of Defamation, Conversion and Breach of Contract, June 10, 2022
Damages: $560,000 total ($110,000 in compensatory damages and $450,000 in punitive damages)
Tom Coffey represented Jennifer Mick, a behavioral analyst who helps people living with severe developmental and behavioral issues by providing them with cognitive therapy and developing behavioral support plans for them so that they can maximize their quality of life. Ms. Mick contracted with the Defendants Applied Behavioral Advancements, LLC and ABA’s owner Christopher George from August 2013 through November 2017. Beginning with an aggressive email on November 20, 2017, Mr. George accused Ms. Mick of committing Medicaid fraud and zealously pursued her as he stated he would in the email to her. He reported her for fraud to the Cabinet for Health and Family Services and its Office of the Inspector General. He told Ms. Mick that she would all but certainly be convicted of multiple felonies. He reported Ms. Mick for fraud to the Behavior Analyst Certification Board and the Kentucky Applied Behavior Analyst Licensure Board for “unethical practices” and “billing [that] had been fraudulent.” Mr. George and ABA took it even further. ABA employees contacted businesses with which Ms. Mick intended to contract with upon leaving ABA to further pursue their crusade against her. Exhausted and suffering, Ms. Mick brought the underlying action in this case against Mr. George and ABA, amongst other claims, defamation, intentional infliction of emotional distress, conversion and breach of contract.
Western District of Kentucky: Shrikanth Nekkanti v. V-Soft Consulting Group. Civil Action No. 3:18-CV-784-BJB (District Judge Benjamin Beaton)
Verdict: For Plaintiff Nekkanti on claim of forgery against V-Soft and its employees, Furthermore, Judge Beaton granted Nekkanti his costs incurred in litigating his claim, October 27, 2021
Judge Beaton denied the Defendant’s motion to dismiss the verdict and/or give a new trial, May 12, 2022
Damages: $86,685 total ($11,685 for lost wages and $75,000 for emotional distress)
Tom Coffey represented Nekkanti in a forgery case. Nekkanti was fired from his job at Anthem because Defendant V-Soft’s employee Saisivakumar Yerramneni, acting in his capacity as a V-Soft employee, forged a document of his to further the most fundamental aspect of V-Soft’s business. Consequently, Defendant V-Soft is liable for its employee Yerramneni’s action and for the resulting damages he caused Plaintiff Nekkanti.

About Tom
Tom and his wife, Nicole, met while both attending Notre Dame Law School. Together they have influenced their three children to become rabid Notre Dame football fans along with them.
